I have to respectfully disagree.

1) Capitalism is a lot more than simply contract law.

2) No contract is perfect, there are always edge cases
   and ways to operate within the letter of the contract
   while still abusing the spirit of the contract. That
   doesn't mean that the contract was drafted improperly.

   In other words it certainly is possible to abuse a
   contract while not violating it.

3) People who abuse the spirit of a contract shouldn't
   be surprised when they are criticized or when they
   discover that people no longer want to enter into a
   contract with them.
