they have to be caught tending or harvesting it for law enforcement to
connect them to it.
However, if the "crop" is on private land and the authorities find it the
owner of the land is liable for arrest and perhaps confiscation of the land
(depending upon the law of the state where it occurs), and also may be
incarcerated as well.
